This type of bankruptcy is usually used to stop foreclosures or for the curing of arrears on mortgages and to address other secured debt claims and tax obligations. It is also a good option for debtors who are unable to qualify for Chapter 7 as a result of the means test. Unlike Chapter 7, which results in liquidation, Chapter 13 allows debtors to retain assets provided they have the income to make monthly payments as part of the bankruptcy plan.
Even if a debtor qualifies for Chapter 7 but has equity in a home, it could be better to file for Chapter 13. Also, it is an attractive option for debtors with tax liabilities, as it allows for the repayment over the course of 60 months in installments.
